The Employer filed timely exceptions to the Recommended Decision and Order pursuant to Section 1200.135 of the Board's Rules and Regulations, 80 Ill. Admin. Code Sec. 1200.135. The Petitioner did not file a response. After reviewing the record, briefs, and exceptions, we reject with the Administrative Law Judge's recommendation, and instead, find that the representation petition raises issues of fact and law that require resolution through the hearing process.
