Decisions and Opinions of the Illinois State Labor Relations Board

 Volume/Number:  2014 December
 Issuing Agency:
Description:  Skokie Firefighter, Local 3033, International Association of Fire Fighters -vs- Village of Skokie: On August 22, 2014, ALJ Heather Sidwell issued a Recommended Decision and Order dismissing a charge filed on February 14, 2014 by the Skokie Firefighters, Local 3033, IAFF, (Union or Charging Party) against the Village of Skokie (Respondent or Village). The charge alleged that the Respondent violated Sections 10(a)(4) and (1) of the Illinois Public Labor Relations Act (Act), 5 ILCS 315 (2012), when it unilaterally changed the status quo ofemployees' terms and conditions of employment during the pendency of interest arbitration proceedings and dealt directly with the Union's members concerning a mandatory subject of bargaining. Both allegations stem from the Respondent's decision to implement a Separation from Employment Reimbursement Agreement (Separation/Reimbursement Agreement orAgreement) policy, under which new firefighters are required to reimburse the Village for training and equipment costs if they resign after less than two years.

Description:  American Federation of State, County and Municipal Employees, Council 31; Glen Bell; Lisa Krebs; Carol Gibbs; David Johnson; Maureen Haugh-Stover -vs- Department of Central Management Services and Illinois State Labor Relations Board: This case deals with a statute aimed at increasing efficiency in the state government by reducing collective bargaining unit membership among management-level state employees. The goal of the statute is to ensure that certain employees' undivided loyalty will be to the executive branch, as collective bargaining unit membership inhibits their ability to manage subordinates with whom they share common interests as collective bargaining members. To further that stated objective, the General Assembly passed a statute that gave the Governor the authority to designate up to 3,580 state employment positions. Designate in this context means that the Governor can file a petition and, so long as the employment position qualifies for exemption under certain statutory parameters, the employee occupying that position becomes excluded from his of her collective bargaining unit.

Description:  Skokie Firefighters Local 3033, IAFF -vs- Village of Skokie: On March 11, 2015, Administrative Law Judge (ALJ Deena Sanceda issued a Recommended Decision and Order in the above-captioned case, finding that the Village of Skokie did not violate sections 10(a)(4) and (1) of the Illinois Labor Public Labor Relations Act, 5 ILCS 315 (2014) as amended (Act), when it submitted to the interest arbitrator language concerning the examination process for the rank of Lieutenant. Specifically relying on our recent decision in City of Wheaton, 31 PERI 131 (IL LRB-SP 2015), in which we reaffirmed that submitting a permissive subject of bargaining to interest arbitration, does not, in and of itself, violate a duty to bargain in good faith under Section 10(a)(4) of the Act, the ALJ recommended the Complaint be dismissed.
