 Description:  Department of Central Management Services (Department of Human Services) -vs- American Federation of State, County and Municipal Employees, Council 31: Section 6.1 of the Illinois Public Labor Relations Act, 5 ILCS 315/6.1 (2012) (Act) added by Public Act 97-1172 (effective April 5, 2013), allows the Governor of the State of Illinois to designate certain public employment positions with the State of Illinois as excluded from collective bargaining rights which might otherwise be granted under the Illinois Public Labor Relations Act. There are three broad categories of positions which may be so designated: (1) positions which were first certified to be in a bargaining unit by the Illinois Labor Relations Board (Board) on or after December 2, 2008; (2) positions which were the subject of a petition for such certification pending on April 5, 2013, (the effective date of Public Act 97-1172); or (3) positions which have never been certified to have been in a collective bargaining unit. Only 3,580 of such positions may be so designated by the Governor, and, of those, only 1,900 positions which have already been certified to be in a collective bargaining unit.

Owen issued a Recommended Decision and Order (RDO) finding the Illinois Department of Central Management Services (Department of Transportation) (Respondent) violated Section 10(a)(4) and (1) of the Act by refusing to supply to Teamsters Local Union #916 (Respondent) information regarding racial and harassment allegations made by an employee. Pursuant to Section 1200.135(b) of the Board's Rules and Regulations, 80 Ill. Admin. Code Parts 1200 through 1240 (Board Rules), the Respondent filed timely exceptions to the ALJ's RDO, to which Charging Party has filed a response. Wells issued a Recommended Decision and Order in the above-captioned case recommending that the Illinois Labor Relations Board, State Panel, find that the City of Markham (Respondent), failed to timely answer the Complaint, and therefore had admitted the material allegations of fact and law.  Description:  Sahin Cakir -vs- Department of Central Management Services: On May 2, 2011, Executive Director John F. Brosnan dismissed the unfair labor practice charge filed by Sahin Cakir (Charging Party) in the above-referenced case. The Charging Party alleged that the State of Illinois, Department of Central Management Services (Respondent) wrongly deducted money from his pay to cover insurance costs while he was on leave pursuant to the Family Medical Leave Act, 29 U.S.C. [sec.] 2601-2654.  Description:  Countiss -vs- Perkins Chief Judge of the Circuit Court of Cook County (Cook County Juvenile Temporary Detention Center): On January 26, 2012, Administrative Law Judge (ALJ) Eileen L. Bell issued a Recommended Decision and Order (RDO) in the above-captioned case, recommending that the Illinois Labor Relations Board, State Panel (Board) dismiss a complaint filed on behalf of Countiss Perkins (Charging Party). The complaint alleged that the Chief Judge of the Circuit Court of Cook County violated Section 10(a)(1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), as amended (Act), by directing Charging Party's supervisors to deny her overtime opportunities because she had grieved prior denials of overtime. Charging Party filed timely exceptions to the RDO pursuant to Section 1200.135 of the Board's Rules, 80 Ill, Admin. Code Parts 1200 through 1240. Respondent filed a timely response. After reviewing the record, exceptions and response, we reverse the ALJ's RDO and remand for a hearing.

 Description:  Policemen's Benevolent Labor Committee -vs- City of Ottawa: On October 19, 2009, Administrative Law Judge John Clifford issued a Recommended Decision and Order in the above-captioned case recommending that the Illinois Labor Relations Board, State Panel, find that the City of Ottawa (Respondent) failed to timely answer the Complaint, and therefore admitted the material allegations of fact and law in the Complaint. Accordingly, he recommended that the Board find Respondent violated Sections 10(a)(4) and derivatively, (1), of the Illinois Public Labor Relations Act, 5 ILCS 315/10(a)(1), (4)(2008), by refusing to bargain in good faith with the Policemen's Benevolent Labor Committee (Charging Party) in that the Respondent's agents failed to recommend that the Respondent's City Council adopt a tentative agreement reached during interest arbitration and in that it either failed to disclose restrictions placed on its legal representative's authority to bargain on its behalf, or retroactively repudiated that authority. The Administrative's Law Judge further recommended the Board deny the Respondent's request for a variance form the Board's Rules and Regulations, 80 Ill. Admin. Code Parts 1200 through 1240, pursuant to Section 1200.160 pf those rules, and deny the Charging Party's request for the award of costs and attorney's fees.
