Charging Party alleged that Respondent, County of Cook and Cook County Sheriff, violated Sections 10(a)(1) and (4) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(a)(1) & (4)(2010), by unilaterally changing bid criteria in such a manner as to present it with a fait accompli.

On November 17, 2011, Executive Director John F. Brosnan dismissed the charge, finding no allegation that the alleged failure to implement a wage increase was intended to interfere with rights under the Act, and that an alleged breach of a collective bargaining agreement is, in itself, insufficient to demonstrate a violation of Section 10(a).

On September 22, 2011, Executive Director John F. Brosnan issued an order deferring consideration of that charge until the parties have completed the grievance resolution process. Charging Party filed a timely appeal of the Executive Director's action pursuant to Section 1200.135. Respondent did not file a response. After reviewing the record and the appeal we uphold the Executive Director's decision to defer this matter for the reasons he set forth in his order.
