On November 17, 2011, Executive Director John F. Brosnan dismissed the charge, finding no allegation that the alleged failure to implement a wage increase was intended to interfere with rights under the Act, and that an alleged breach of a collective bargaining agreement is, in itself, insufficient to demonstrate a violation of Section 10(a).

After reviewing the record and the appeal we uphold the Executive Director's decision to defer this matter for the reasons he set forth in his order.
