 Description:  Illinois Office of the Comptroller -vs- International Union of Operating Engineers Local No. 965: On November 22, 2013, Administrative Law Judge (ALJ) Martin Kehoe issued a Recommended Decision and Order (RDO) in which he determined that the unit clarification petition filed by the Illinois Office of the Comptroller (Petitioner) was appropriate. Accordingly, the ALJ determined that pursuant to Section 3(n) of the Illinois Public Labor Relations Act, 5 ILCS 315, (Act), the Public Service Administrators (PSAs) employed by the Petitioner should be excluded from any existing bargaining units. The PSAs have been represented by the International Union of Operating Engineers, Local No. 965 (Union). The ALJ recommended that the Board reject the Unions arguments in opposition to the petition.

 Description:  Department of Central Management Services (Department of Human Services) -vs- American Federation of State, County and Municipal Employees, Council 31: Section 6.1 of the Illinois Public Labor Relations Act, 5 ILCS 315/6.1 (2012) (Act) added by Public Act 97-1172 (effective April 5, 2013), allows the Governor of the State of Illinois to designate certain public employment positions with the State of Illinois as excluded from collective bargaining rights which might otherwise be granted under the Illinois Public Labor Relations Act. There are three broad categories of positions which may be so designated: (1) positions which were first certified to be in a bargaining unit by the Illinois Labor Relations Board (Board) on or after December 2, 2008; (2) positions which were the subject of a petition for such certification pending on April 5, 2013, (the effective date of Public Act 97-1172); or (3) positions which have never been certified to have been in a collective bargaining unit. Only 3,580 of such positions may be so designated by the Governor, and, of those, only 1,900 positions which have already been certified to be in a collective bargaining unit.

 Description:  Teamsters Local Union #916 -vs- Department of Central Management Services (Department of Transportation): On August 10, 2012, Administrative Law Judge (ALJ) Michelle N. Owen issued a Recommended Decision and Order (RDO) finding the Illinois Department of Central Management Services (Department of Transportation) (Respondent) violated Section 10(a)(4) and (1) of the Act by refusing to supply to Teamsters Local Union #916 (Respondent) information regarding racial and harassment allegations made by an employee. Pursuant to Section 1200.135(b) of the Board's Rules and Regulations, 80 Ill. Admin. Code Parts 1200 through 1240 (Board Rules), the Respondent filed timely exceptions to the ALJ's RDO, to which Charging Party has filed a response. For the Following reasons, we affirm the ALJ's recommended finding of a violation, but alter her recommended remedy.

 Description:  Teamsters Local Union 700 -vs- City of Markham: On August 23, 2010, Administrative Law Judge Sharon B. Wells issued a Recommended Decision and Order in the above-captioned case recommending that the Illinois Labor Relations Board, State Panel, find that the City of Markham (Respondent), failed to timely answer the Complaint, and therefore had admitted the material allegations of fact and law. Accordingly, she recommended the Board find the Respondent violated Sections 10(a)(7) and, derivatively, (1) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(a)(1), (7)(2008), by failing and refusing to execute a successor bargaining agreement. The Administrative Law Judge further recommended that the Board deny a motion filed by Teamsters Local Union 700 (Charging Party) for the award of costs and attorney's fee as sanctions for the Respondent's response to a show cause order.
