.Supreme Court Summaries Opinions filed January 21, 2011 No. Uldrych v. VHS of Illinois, Inc. Appellate citation: Ill. App. 3d 696. JUSTICE KARMEIER delivered the judgment of the court, with opinion. Chief Justice Kilbride and Justices Freeman, Thomas, Garman, and Burke concurred in the judgment and opinion. Justice Theis took no part in the decision. The parties involved in this appeal were all named as defendants in medical malpractice action. In February of 2003, man had gastric bypass surgery at MacNeal Hospital. In February of 2005, Cook County medical malpractice action was filed against, among others, the hospital, the two operating surgeons, and surgical association which allegedly employed them. Subsequently, the patient died and his wife, who became special administrator of his estate, added claims for survival and wrongful death. Negligence on the part of the doctors was alleged, along with the vicarious liability of the hospital and surgical association. In August of 2008,
